Public hearings were held to rezone 155.03 acres of land in East Allen from Agricultural zoning to Light Industrial/Business Park zoning.  On October 18, 2017, at the conclusion of the three public hearings and with major resistance from local residents, East Allen Board of Supervisors voted 5 – 0 to keep the parcel of land Agricultural. On November 17, 2017 the Rockefeller Group filed in Northampton County a Notice of Appeal. “Appellee’s Denial of the Petition Constitutes an Erroneous, Arbitrary and Capricious Abuse of Discretion and an Error of Law”.
Here are some key line items in the Notice to Appeal.
  • Appellee failed to deliberate or discuss the testimony or evidence presented by Appellant.
  • Appellee immediately voted to deny the Petition. Appellee unanimously approved the Comprehensive Plan less than one (1) month prior to Appellant’s filing of the Petition.
  • The Decision includes no discussion or conclusions relative to the basis for denial of the Petition.
